Acton's Two-Unit Rule Is Halton Hills-Wide. Its Pre-War Lots Are Not.

Since 2 January 2025, a serviced Acton house can carry up to two additional residential units, the same Halton Hills rule Georgetown gets. What is different here is the ground under it: a mill-town grid of lots generally built before 1975, Mature Neighbourhood zoning across much of it, and Black Creek flood mapping that Credit Valley Conservation is still redrawing.

What Halton Hills lets you add on an Acton lot

The rules are Town-wide, so they match Georgetown's, and they are recent. Council approved Official Plan Amendment 58 and Zoning By-law 2024-0098 on 9 December 2024; with no appeals filed, both were in effect as of 2 January 2025. On a fully serviced residential lot you may have two additional residential units in one of two arrangements: two inside the house, together no more than 60 per cent of its floor area or 220 m², whichever is less; or one inside (40 per cent or 110 m²) plus one detached (40 per cent or 90 m² in the urban zones). A unit contained entirely within the basement may take the whole basement floor. Every unit must share one driveway.

Parking is two spaces for the house plus one per unit, each at least 2.75 m by 5.5 m. A detached unit goes in the interior or rear yard: 1 m from an interior lot line if no windows face it, 2 m if they do, 1.5 m from the rear line, its roof at least 1 m lower than the house and no higher than 6.5 m. You must keep clear, unobstructed access into the rear yard from the front or side yard. With a unit established, lot coverage may reach 45 per cent in Mature Neighbourhood zones and 60 per cent elsewhere.

Occupancy is not permitted until the unit is registered under By-law 2023-0060. Registration is a separate application filed with the building permit, and both the Town and the Electrical Safety Authority inspect first.

Acton's lots: a pre-1975 mill-town grid with (MN) zoning on top

Acton predates most Halton Hills housing. The Adams brothers arrived in 1829, the post office renamed Adamsville to Acton in 1844, and George Beardmore's tannery grew into the largest tanning operation in the British Empire. That history is in the lots. The Town's 2017 Mature Neighbourhoods Character Study sorted Acton into pre-war neighbourhoods — Mill Street, and Bower Street, which it labelled the Syndicate Housing Heritage Conservation District — and post-war 'Acton Neighbourhoods', then drew a Mature Neighbourhoods (MN) suffix around areas generally developed before 1975, on larger lots, with single-detached houses.

If your address shows an (MN) suffix on the Town's interactive Zoning Map, tighter numbers apply: 10 m and 2.5 storeys maximum; lot coverage of 40 per cent for one- and one-and-a-half-storey houses and 35 per cent for two storeys in LDR1-1 and LDR1-2; interior side yards of 1.2 m for one storey and 1.8 m for two; no second-storey balcony or deck in the interior side yard. A second storey on a bungalow is judged against the 35 per cent line. And the by-law counts a walkout basement as a storey once its ceiling sits 1.8 m or more above established grade, so on sloping lots toward Fairy Lake a tall walkout can eat into the 2.5-storey cap.

The Official Plan also caps Acton's low-density areas at 15 units per net hectare against Georgetown's 20, and holds the South Acton Special Study Area, former industrial land left vacant by servicing constraints, to a comprehensive plan first.

How HMH approaches an older Acton basement

In a pre-war Acton house the first question is headroom, and we answer it with a tape. Ontario's second-unit rules allow a basement unit a ceiling of 1.95 m over the entire required floor area, and Halton Hills wants every room's ceiling height on the drawings, including the height at the lowest point of the bulkheads. So we measure to the underside of the joists and the bottom of the main trunk duct and tell you whether the ceiling clears or you are lowering the floor. The Town's fee schedule has a line for shoring and underpinning; that tells you how often it comes up.

A separate entrance is a permit of its own: Halton Hills lists basement walkouts among projects needing a permit, the section must show the distance from grade to the floor and the underside of the footing, and the site plan must show every exterior entrance, walkout stairs, egress windows and window wells. We prepare those drawings, carry the application and hold our three-day site schedule for the entrance: excavate, form and pour the stairwell, set the door and sill, back-grade and tie in the drain.

Inside, the Building Code asks for a 30-minute fire separation between units and common areas, smoke alarms on every level and in each bedroom of the unit, and carbon monoxide alarms where there is a fuel-burning furnace or attached garage. That is ordinary work; Acton's surprises are the age of the framing and the size of the water service, which the Town asks you to calculate on the submission.

Black Creek, Fairy Lake and Credit Valley Conservation

Acton drains to Black Creek inside the Credit River watershed, which puts it under Credit Valley Conservation rather than Conservation Halton. CVC, the Town and Halton Region are running a Sustainable Neighbourhood Action Plan for Acton covering Black Creek, Bovis Creek and Fairy Lake, including a study of restoring 1.8 km of Bovis Creek upstream of the lake and a project updating outdated floodplain maps to clarify flood risk to homes and businesses. If your lot backs onto the valley land along Black Creek, the line that governs your yard may move.

The Official Plan does not permit new development within the Regulatory Floodplain as mapped by the conservation authority; those lands sit in Greenlands A. On an existing lot in the floodplain or below the stable top of bank, only minor additions, replacement structures, pools and non-habitable accessory buildings may be permitted, subject to the conservation authority. One Acton medium-density site bisected by a Black Creek tributary has no regulatory floodplain mapping at all, so only existing uses are allowed there. Since 1 April 2024 those permits run under Ontario Regulation 41/24, which counts construction of a building or structure, additional dwelling units and site grading as development activities, so a separate-entrance excavation in a regulated area needs a CVC permit before the building permit.

The Niagara Escarpment bisects Halton Hills from southwest to northeast and Acton sits near it. Within the Niagara Escarpment area the Town requires an NEC development permit or exemption letter before issuing a building permit; the Commission's online map is the check.

Permits, drawings, fees and inspections in Halton Hills

Halton Hills requires a permit for additions, basement walkouts, basement apartments and finishing basements; applications go through the Town's online building application. Most small housing projects need two sets of drawings — site plan, lot grading plan where applicable, floor plans, elevations, roof framing, sections, details and HVAC design — from a designer registered with the Ministry of Municipal Affairs and Housing, an engineer or an architect. For a house, addition or renovation the Chief Building Official issues a permit or refusal letter within ten working days of a complete application.

Fees are a service index times floor area. The 2026 schedule sets a basement finish at $9.64 per m², residential alterations at $10.42 per m², a new house or addition under 475 m² at $23.54 per m², a walkout, exterior stair or ramp at a flat $278.97, and shoring and underpinning at $15.21 per m² with a $789.69 minimum. ARU registration is $1,252.54, or $262.47 if pre-approved through the permit. Start without a permit and the fee is 1.5 times the full amount.

Book inspections with 48 hours' notice. An open permit is an order against the property, which bites when you sell or refinance, and a permit can be revoked if work has not started within six months. An existing apartment is judged by its age: one that existed on or before 14 July 1994 is inspected against Ontario Fire Code Retrofit 9.8, a later one against the Building Code, and renting an unregistered unit risks fines of up to $50,000 for an individual.

Servicing, heritage and downtown Acton

Every Halton Hills resident drinks groundwater, and most of it comes from municipal wells in the Georgetown and Acton urban areas. The Official Plan is blunt that growth in the Acton urban area is constrained by servicing. For you that means Region of Halton Engineering signs off on any new water or sanitary connection, and the Town wants your water service line size calculated when you add a unit; an older service may not carry two kitchens and two bathrooms.

The 1882 Town Hall became Halton Hills' first designated historic building in 1988, and the Heritage Register runs to dozens of Acton entries clustered on Bower, Church, Frederick, John and Agnes streets. Listing is lighter than designation: Council consent is not required to alter a listed property, though the Town strongly encourages consulting heritage staff first, and an owner must give 60 days' notice before demolishing anything on a listed lot. Common Questions From Acton Homeowners

Do I need a permit to finish my basement in Acton?

Yes. Halton Hills lists finishing basements, basement walkouts and creation of basement apartments among the projects that require a building permit, and the permit is issued by the Town, not the Region. The 2026 fee for a basement finish is $9.64 per square metre of the area being worked on, and a walkout is a flat $278.97 on top. You will need two sets of drawings, including floor plans and sections, and each inspection is booked with 48 hours' notice. Starting without a permit raises the fee to 1.5 times the full amount and leaves an order on title.

Can I add a basement apartment to my house in Acton?

Yes, if the house is a single, semi or townhouse on municipal services. Halton Hills permits up to two additional residential units per lot: two inside the house, or one inside plus one detached. A unit contained entirely in the basement may take the whole basement floor. You need one extra parking space of at least 2.75 m by 5.5 m per unit on top of two for the house, all on a shared driveway, and the unit cannot be occupied until it is registered under By-law 2023-0060 after inspections by the Town and the Electrical Safety Authority.

Can I build a garden suite or coach house on an Acton lot?

Yes, within firm limits. A detached additional residential unit must sit in the interior or rear yard, no closer to the street than the house, 1 m from an interior lot line without windows facing it or 2 m with windows, and 1.5 m from the rear line. Its roof must be at least 1 m lower than the house and no higher than 6.5 m, its floor area no more than 90 m² or 40 per cent of the house, and you must keep clear, unobstructed access into the rear yard. On Acton's 9 m to 18 m frontages, we measure that path first.

What does the (MN) on my Acton zoning mean for an addition?

It means your street is in a Mature Neighbourhood zone and stricter standards apply. Halton Hills drew the (MN) suffix around areas generally developed before 1975 on larger single-detached lots in Georgetown and Acton. In LDR1-1 and LDR1-2 the cap is 10 m and 2.5 storeys, lot coverage is 40 per cent for one- and one-and-a-half-storey houses but 35 per cent for two storeys, interior side yards are 1.2 m for one storey and 1.8 m for two, and no balcony or deck is allowed on a second storey in the interior side yard. With an additional unit established, coverage may rise to 45 per cent.

Is my Acton house in a Black Creek flood zone?

Check with Credit Valley Conservation before you plan anything, because the maps are changing. CVC, the Town and Halton Region are updating Acton's outdated floodplain mapping as part of the Acton Sustainable Neighbourhood Action Plan covering Black Creek, Bovis Creek and Fairy Lake. The Official Plan does not permit new development inside the Regulatory Floodplain, and on an existing lot in the floodplain only minor additions, replacement structures, pools and non-habitable accessory buildings may be allowed, subject to CVC. Since 1 April 2024 CVC permits run under Ontario Regulation 41/24, which covers new buildings, additional dwelling units and site grading.

Does the Niagara Escarpment Commission apply in Acton?

Only if your property is inside the Niagara Escarpment area, and you should check the Commission's map rather than assume. The escarpment bisects Halton Hills from southwest to northeast and Acton sits near it. Where a property is within the area, the Town will not issue a building permit until you hold either an NEC development permit or an exemption letter. Not every project inside the development control area needs a permit, but the Town wants the letter either way. We check the NEC map alongside the zoning map at the first visit.

My Acton house already has a basement apartment. How do I make it legal?

Apply to register it with Halton Hills Building Services and expect inspections. The Town's two-unit house process sends municipal law enforcement to check zoning and property standards, fire inspectors if the unit existed on or before 14 July 1994 (it is then assessed against Ontario Fire Code Retrofit 9.8), and building inspectors if it was created after that date. Upgrades may need their own building permit before registration. Continuing to rent an unregistered unit carries fines of up to $50,000 for an individual and $100,000 for a corporation, and the 2026 registration fee is $1,252.54.

Is Acton on municipal water and sewer, or wells and septic?

The Acton urban area is on municipal water and wastewater, but the water itself is groundwater. All Halton Hills residents drink groundwater, and most of it is pumped from municipal wells in the Georgetown and Acton urban areas. The Town's Official Plan states plainly that Acton's growth is constrained by servicing. For a second unit that means the Region of Halton Engineering Department approves any new water or sanitary connection, and the Town asks for a calculation of your water service line size with the drawings. Rural lots outside the urban boundary are a different case: a detached unit there must share the house's septic system.

How high does my Acton basement ceiling need to be for a legal unit?

At least 1.95 m over the entire required floor area, under Ontario's rules for a second unit in an existing house. Halton Hills asks for the ceiling height of every room to be shown on the drawings, including the height at the lowest point of any bulkhead, so the duct under the joists counts, not just the open span. In Acton's pre-war houses that is the number that decides between a straightforward finish and lowering the floor, which the Town's fee schedule prices as shoring and underpinning at $15.21 per square metre with a $789.69 minimum.
