In Erin the Second Unit Question Starts at the Septic Tank, Not the Basement

Erin's Water Resource Recovery Facility entered commissioning in July 2026, but the Town says only new developments connect as the system is built; existing homes in Erin village and Hillsburgh wait on funding and a connection by-law still being written. Until then your house is on a private septic system, and Zoning By-law 07-67 makes proving that system can carry two units the first test of any additional residential unit.

What Zoning By-law 07-67 allows on an Erin lot

Section 4.1 of Comprehensive Zoning By-law 07-67, March 2026 consolidation, permits a maximum of two additional residential dwelling units on a lot: one inside the house plus one in a separate building, or two inside the house. Each unit may have no more than two bedrooms and no more than 50 per cent of the primary unit's floor area, up to 130 square metres. The exception that matters for most Erin houses is Section 4.1.2: a basement unit may occupy the entire basement floor area. Each dwelling unit needs its own separate, private entrance, and exterior alterations go to the rear or side of the house unless you are converting an existing garage.

Parking is one space per additional unit on top of what the main building needs, and driveway access is limited to one. The lot must front on an open, municipally maintained street. No unit is permitted within hazardous lands identified by the conservation authority, on a lot with a bed and breakfast, boarding house or home industry, or where a garden suite already stands.

A detached unit sits within 40 metres of the house but at least 3 metres from it, cannot be taller than the house, and follows the accessory rules: 4.5 metres tall outside agricultural zones, all accessory buildings together no more than 10 per cent of the lot, and 116 square metres of ground floor on a lot of 0.8 hectares or less.

Permits, fees and the Cloudpermit process

Every additional residential unit needs a building permit, and the Town's process is 100 per cent paperless through Cloudpermit; inspections are booked there too. The site plan must show the existing well and septic system with setbacks to it. Where plumbing is proposed on a septic lot, a qualified designer must provide a letter stating the system's capacity and condition; a new septic design is a separate permit. Before you submit, the Town asks you to check the Credit Valley Conservation and Grand River Conservation Authority regulation mapping and the county's source water protection mapping, because agency approval is required before a permit is issued.

Fees come from Fees and Charges By-law 26-01, passed 22 January 2026, which repealed the By-law 24-36 the Town's fee page still names. The minimum permit fee for a house with no more than two units is $200. A new secondary dwelling unit within an existing house is $1,790 or $7.70 per square metre, whichever is higher; an addition, alteration or renovation is $2,672 or $11.50 per square metre; finishing a basement is a flat $550; a below-grade entrance is $330 or $3.55 per square metre; a new or enlarged opening, and plumbing, are $330 each. Septic fees are their own line: $825 for a new system, $500 for a tank or bed replacement, $330 for an evaluation.

Construction must start within six months of issuance. The Province collects no development charges on a second unit in an existing house.

Servicing, the Credit River headwaters and heritage

The Official Plan, consolidated March 2025, states it plainly: there are no municipal sanitary sewage facilities in the Town of Erin, and all treatment is by individual private systems. That is changing. The Town's 1 September 2026 project update reports the Water Resource Recovery Facility on Wellington Road 52 began its first phase of commissioning on 8 July 2026, the Erin Village sewage pumping station finished commissioning on 13 August 2026, and the Ontario Clean Water Agency has taken over the station. The plant will serve Hillsburgh and Erin village and discharge to the West Credit River; its effluent cooling system is still flagged as a schedule risk.

For an existing house the timing is different. The Town's wastewater FAQ says new developments connect immediately as the system is built, while connections for existing properties inside the urban boundary depend on funding from higher levels of government, and a sewer by-law setting out who must connect and what it costs is still being worked on. Plan the septic case now and the sewer tie-in later.

Erin sits on the Credit River headwaters; the Town's Hillsburgh Dam study puts that area almost entirely inside CVC's regulation limit, and the south and west drain to the Grand system. Under Heritage By-law 23-17 a designated property needs a heritage permit to alter, and a listed non-designated property has its permit circulated to the Heritage Committee, with 60 days' notice before demolition.

Erin's housing stock, era by era

The 2021 Census counted 11,981 people and 4,220 occupied dwellings in the Town of Erin, 3,860 of them single-detached houses. The build dates tell you what you will find in the basement: 1,005 built in 1960 or earlier, 1,450 between 1961 and 1980, 675 in the 1980s, 435 in the 1990s, and only 655 in the two decades after 2000. The Township's own history notes that city people have been buying sites for country homes here since the 1960s, which explains the 1961 to 1980 bulge: bungalows and side-splits on large lots with a septic bed sized for one household.

The two villages are older. Erin grew up after mills were built on the Credit River between 1826 and 1829; Hillsburgh was settled in 1821 and became a police village in 1899. Their Main Street and Trafalgar Road cores hold the pre-1961 stock and the thickest part of the heritage register.

In any of these houses the Ontario Building Code sets the floor: a basement second unit may have a ceiling height of 1.95 metres, an egress window at or below grade needs an unobstructed opening of at least 0.38 square metres, there must be a 30-minute fire separation between units and common areas, and smoke alarms go on every level and in each bedroom. A 1970s bungalow with a full-height basement usually clears the headroom; the septic letter is the harder test.

How HMH sequences the job in Erin

Then the septic: a qualified designer assesses capacity and condition and writes the letter the Town requires; if the system cannot carry a second household the answer is a new or enlarged system on its own permit, or waiting for the sewer.

With the servicing case made, we design the unit to Section 4.1 and the Code, permit it through Cloudpermit, and build. The separate basement entrance is our specialty and usually the first piece of site work: engineering, excavation, forming and pouring the stairwell, door and sill, waterproofing and back-grading, with the site work done in three days. Erin prices a below-grade entrance as its own permit line and wants it on the site plan, so we draw it that way from the start.

Can I put a basement apartment in my Erin house if I am on septic?

Yes, if the septic system can prove it can carry both units. Zoning By-law 07-67 permits additional residential units only where adequate water and sanitary servicing is available to the Town's satisfaction, and where municipal services are not available you must provide proof that the private water and sewage services can accommodate the primary unit and the additional unit. In practice the Town's permit guides require a qualified designer's letter stating the existing septic system's capacity and condition. If it falls short, a new or altered system is a separate septic permit.

Is the Erin sewer system running yet, and when can my existing house connect?

The plant is commissioning, but existing homes are not connecting yet. Two. Section 4.1 of the zoning by-law allows a maximum of two additional residential dwelling units on a lot, either one inside the house and one in a separate building, or two inside the house. Each unit is capped at two bedrooms and at 50 per cent of the primary unit's floor area up to 130 square metres, except that a unit located in the basement may occupy the entire basement. Both units need adequate servicing, one parking space each, and a lot that fronts on an open, municipally maintained street.

Do I need a permit to finish my basement in Erin?

Yes. The Town requires a building permit before starting new construction or renovation projects, and its 2026 fee schedule prices finishing a basement within a single-family dwelling at a flat $550, with plumbing at $330 and a new or enlarged door or window opening at $330 as separate line items. Applications go through Cloudpermit, and construction must start within six months of issuance. If the finished basement is really a future apartment, permit it as a secondary dwelling unit from the start rather than converting later.

What does an additional residential unit permit cost in Erin?

Yes. Section 4.1.2 of the zoning by-law says each dwelling unit shall have a separate, private entrance, which is stricter than the Building Code's option of a shared, fire-separated exit. Exterior alterations for the unit go to the rear or side of the house unless you are converting an existing garage. The Town prices a below-grade entrance as its own permit item and wants it, with any window wells, on the site plan. HMH builds the separate entrance with the site work done in three days.

My property is near the Credit River or a wetland. Can I still add a unit or an addition?

Often, but the conservation authority decides first. Erin is split between Credit Valley Conservation and the Grand River Conservation Authority, the Town asks you to check both regulation maps before applying, and agency approval is required before a building permit is issued. The zoning by-law also prohibits any additional residential unit within hazardous lands identified by the conservation authority. Under the Conservation Authorities Act the authority reviews and decides on its own permit first, and that permit still does not let you start before the building permit is issued.

Can I build a garden suite or coach house behind my Erin house?

Yes, as a detached additional residential unit. It must sit on the same lot within 40 metres of the house but at least 3 metres from it, in the interior side, exterior or rear yard while meeting the zone's yard standards, screened to the Town's satisfaction, no taller than the house and within the 4.5-metre accessory-building height limit. All accessory buildings together are capped at 10 per cent of the lot, with 116 square metres of ground floor on lots of 0.8 hectares or less. On septic, it needs the same servicing proof as an inside unit.
